1. Scope

1.1  This Sale Policy governs all purchases of NexoChart subscription plans and applies in addition to, and should be read alongside, our Terms of Service, Privacy Policy, and Disclaimers. In the event of a direct conflict between this Sale Policy and the Terms of Service specifically regarding payment, billing, or refunds, this Sale Policy controls.

2. Products Offered

2.1  NexoChart currently offers the following paid subscription plans (collectively, "Plans"):

  • Monthly Plan — USD $40 per month, billed on a recurring basis every 30 days from the date of initial purchase, until cancelled.
  • Lifetime Plan — USD $180, billed once as a single payment, granting access to NexoChart for as long as we continue to operate the Service, subject to Section 8 (Service Availability) and Section 10 (Termination).

2.2  Prices are stated in US dollars and are exclusive of any applicable taxes, VAT, GST, or similar charges, which will be calculated and added at checkout based on your billing location where required by law.

2.3  We reserve the right to introduce new plans, modify the features included in existing plans, or change pricing for new purchases at any time. Changes to pricing will not retroactively alter the price of a Lifetime Plan already purchased, and any change to Monthly Plan pricing will apply only from your next billing cycle following at least 30 days' advance notice.

3. Payment

3.1  Payment is processed through our third-party payment processor. By submitting payment information, you represent that you are authorized to use the payment method provided.

3.2  For the Monthly Plan, you authorize us (via our payment processor) to charge your payment method automatically on each renewal date until you cancel in accordance with Section 6.

3.3  If a payment fails, we may retry the charge, suspend your access to paid features until payment is successfully collected, and/or notify you to update your payment details.

4. All Sales Are Final — No Refunds

4.1  General policy. Except as expressly required by applicable law or as set out in Section 5, all purchases of the Monthly Plan and the Lifetime Plan are final and non-refundable. This includes, without limitation:

  • partial-month refunds for the Monthly Plan if you cancel partway through a billing cycle (you retain access until the end of the paid period, but no pro-rated refund is issued);
  • refunds for the Lifetime Plan for any reason, including a change of mind, non-use, dissatisfaction with AI Output accuracy, or trading losses incurred while using the Service;
  • refunds requested after a chargeback or payment dispute has already been initiated through your card issuer or payment provider, without first contacting us.

4.2  Why we operate a no-refund policy. NexoChart provides immediate access to digital analysis tools and AI-generated Output upon purchase. Once Output has been generated or access has been granted, the service cannot be "returned," and we incur immediate compute and data-licensing costs in delivering it. You acknowledge this policy at the time of purchase and confirm that you have reviewed available information about the Service (including its Disclaimers and limitations) before purchasing.

4.3  Acknowledgment at checkout. You will be required to affirmatively acknowledge this no-refund policy before completing payment.

5. Limited Exceptions — Where Refunds May Be Legally Required

5.1  Notwithstanding Section 4, this Sale Policy does not exclude or limit any statutory right to a refund, repair, or replacement that cannot lawfully be excluded in your jurisdiction. Depending on where you are located, applicable consumer protection law may require us to provide remedies in circumstances such as:

(a) EU/UK distance-selling and consumer rights. Consumers in the EU and UK generally have a statutory right to withdraw from a distance contract for digital services within 14 days without giving a reason — except where you have expressly consented to immediate performance of the service and have acknowledged that you thereby lose your right of withdrawal once performance begins or is complete. By purchasing and immediately accessing NexoChart's AI features, you provide this consent and acknowledgment, and accordingly waive the 14-day withdrawal right to the extent permitted by applicable law.

(b) Australian Consumer Law and similar regimes. Some jurisdictions guarantee consumers a remedy where a digital service is not provided with acceptable quality or fails to match its description, and such guarantees cannot be excluded by contract. Nothing in Section 4 is intended to exclude such non-excludable guarantees; where they apply, we will provide the remedy required by law.

(c) Duplicate or erroneous charges. If you were charged in error (e.g., a duplicate transaction caused by a technical fault), contact us promptly and we will investigate and correct genuine billing errors.

(d) Failure to deliver the Service. If you paid for a Plan and, due to a fault attributable to us, were never granted functioning access to the Service, contact us so we can resolve the access issue or, if we cannot, consider a remedy on that specific basis.

5.2  Requests under this Section 5 should be submitted to support@nexochartai.com with your account email and order/transaction reference. We will assess each request against applicable law and respond within a reasonable time.

6. Cancellation

6.1  Monthly Plan. You may cancel your Monthly Plan at any time through your account settings or by contacting support@nexochartai.com. Cancellation stops future renewal charges; it does not entitle you to a refund for the current billing period, and you will retain access to paid features until the end of the period you already paid for.

6.2  Lifetime Plan. The Lifetime Plan is a one-time purchase with no recurring billing, so there is no "cancellation" in the renewal sense. You may stop using the Service, or request closure of your account, at any time; doing so does not entitle you to a refund under Section 4.

6.3  Cancelling your subscription does not automatically delete your account or data; for data deletion, see our Privacy Policy.

7. Chargebacks and Payment Disputes

7.1  If you believe you were charged in error, we ask that you contact us first at support@nexochartai.com before initiating a chargeback or payment dispute with your bank or card issuer, so that we have an opportunity to investigate and resolve the issue directly.

7.2  We reserve the right to suspend or terminate access to the Service for any account associated with a fraudulent, abusive, or bad-faith chargeback, and to dispute such chargebacks through the applicable payment network.

8. Service Availability (Particularly Relevant to Lifetime Plan)

8.1  We will use commercially reasonable efforts to keep NexoChart available and to honor Lifetime Plan access for as long as we operate the Service. However, you acknowledge that:

  • the Service depends on continued access to third-party market data feeds and AI infrastructure providers, which we do not control;
  • we may need to modify, suspend, or discontinue features, or the Service as a whole, due to business, technical, legal, or data-licensing reasons; and
  • "lifetime" refers to the operational lifetime of the Service as offered by us, not a guarantee of perpetual operation regardless of business circumstances.

8.2  If we discontinue the Service entirely, we will provide Lifetime Plan holders with reasonable advance notice where practicable. Discontinuation of the Service is not, by itself, grounds for a refund under Section 4, except where required by applicable law.

9. Price Changes and Promotions

9.1  Promotional or discounted pricing is valid only for the period stated at the time of purchase and does not entitle you to retroactive discounts on prior purchases or guaranteed future pricing, except as expressly stated in the applicable promotional terms.

10. Termination of Access for Breach

10.1  We may suspend or terminate your access to the Service, without refund, if you breach our Terms of Service, this Sale Policy, or applicable law, including through fraudulent payment activity, abuse of the Service, or unauthorized resale or sharing of account access.

11. Relationship to Disclaimers

11.1  Your purchase of a Plan does not change, expand, or override the limitations set out in our Disclaimers and Limitation of Liability. In particular, no purchase entitles you to a refund on the basis that AI-generated Output was inaccurate, that a trade or investment based on Output resulted in a loss, or that Output did not meet your subjective expectations, except where applicable law provides otherwise.

13. Changes to This Sale Policy

13.1  We may update this Sale Policy from time to time. Material changes will be notified through the Service or by email with reasonable advance notice before taking effect for future purchases or renewals. Continued use of the Service after changes take effect constitutes acceptance of the revised Sale Policy.
