1.2  Nothing generated, displayed, transmitted, or otherwise made available through NexoChart constitutes financial advice, investment advice, trading advice, tax advice, legal advice, or a recommendation of any kind to buy, sell, hold, or otherwise transact in any security, cryptocurrency, derivative, commodity, or other financial instrument.

1.3  We are not a registered investment adviser, broker-dealer, financial planner, or financial institution in any jurisdiction. Nothing on or within NexoChart should be construed as the provision of services that require such registration, and you should not treat any output as a substitute for advice from a licensed and regulated professional.

1.4  Any analysis, pattern recognition, signal, indicator, commentary, or output ("Output") produced by NexoChart's artificial intelligence is generated through automated, probabilistic, and statistical processes. 2. Fair Use and Analytical Limitations

3.2  By using NexoChart, you acknowledge and agree that:

4.1  NexoChart, including all Output, data, content, and the platform itself, is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, timeliness, or that the service will be uninterrupted, secure, or error-free.

4.2  We do not warrant that any Output will be accurate, complete, current, or suitable for your particular purposes, or that any defects or errors will be corrected.

4.3  No advice or information, whether oral or written, obtained from us or through NexoChart, shall create any warranty not expressly stated in these terms.

5. Limitation of Liability

5.1  To the maximum extent permitted by applicable law, in no event shall Atlas Holdings, NexoChart, or our officers, directors, employees, contractors, agents, licensors, or suppliers (collectively, the "Atlas Parties") be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of capital, trading losses, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your access to or use of (or inability to access or use) NexoChart, regardless of the legal theory asserted, and even if we have been advised of the possibility of such damages.

5.2  To the maximum extent permitted by applicable law, the total aggregate liability of the Atlas Parties for any and all claims arising out of or relating to NexoChart shall not exceed the lesser of: (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100).

5.3  Nothing in this section is intended to exclude or limit liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by proven gross negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties; in such jurisdictions, our liability is limited to the smallest extent permitted by law.

5.4  You acknowledge that the limitations in this section reflect a reasonable allocation of risk between you and us, and that we would not be able to provide NexoChart at the current price without these limitations.

6. Indemnification

6.1  You agree to defend, indemnify, and hold harmless the Atlas Parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use or misuse of NexoChart; (b) your violation of these Disclaimers, our Terms, or applicable law; (c) any trading or investment decision you make, whether or not informed by Output; or (d) your violation of any third-party right, including intellectual property or data rights relating to underlying market data.

7. Third-Party Data and Services

7.1  NexoChart may incorporate market data, charting feeds, and other information licensed or sourced from third-party providers. We do not own this underlying data and make no representations as to its accuracy, completeness, or timeliness. Your use of such data through NexoChart remains subject to the rights of the original data provider, and to the fair use limitations described in Section 2.

7.2  We are not responsible for the acts, omissions, errors, outages, or pricing of any third-party data provider, payment processor, or other service integrated with NexoChart.

8. No Guarantee of Profit

8.1  We make no claim, promise, or guarantee, express or implied, that use of NexoChart will result in profit or will not result in loss. Any testimonial, case study, or example of past results presented by us is illustrative only, is not typical, and is not a representation that you will achieve similar results.

9. Regulatory and Jurisdictional Notice

9.1  NexoChart is made available globally on an "as is" basis. We make no representation that NexoChart or its Output is appropriate, legal, or available for use in every jurisdiction. If you access NexoChart from a jurisdiction where its use is restricted or prohibited, you do so at your own risk and are responsible for compliance with local law, including local financial promotion and securities laws.

9.2  You are responsible for determining whether your use of NexoChart, and any trading activity you undertake, complies with the laws and regulations applicable to you, including those of your country of residence and the jurisdiction in which any relevant exchange or asset is regulated.

10. Changes to This Disclaimer

10.1  We may update this Disclaimer from time to time to reflect changes to NexoChart, legal requirements, or our practices. The "Last updated" date above indicates the most recent revision. Material changes will be notified in accordance with our Terms of Service. Continued use of NexoChart after changes take effect constitutes acceptance of the revised Disclaimer.

11. Severability and Acknowledgment

11.1  If any provision of this Disclaimer is found unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
